PLAY THESE LOUD FILMMAKER SALES INCENTIVE - TERMS & CONDITIONS

By participating in PLAY THESE LOUD Film Festival ("the Festival"), filmmakers may be eligible to receive a revenue share under the Festival's Filmmaker Sales Incentive Program.

1. ELIGIBILITY

The Filmmaker Sales Incentive is available only to filmmakers whose works have been officially selected and programmed by PLAY THESE LOUD.

2. REFERRAL CODE

Each participating filmmaker will be provided with a unique referral code for ticket sales tracking purposes. The referral code is non-transferable and may only be used in connection with the promotion of the filmmaker's selected work.

3. REVENUE SHARE

Participating filmmakers will receive twenty percent (20%) of eligible net ticket sales attributed to their assigned referral code.

4. ELIGIBLE SALES

Only ticket purchases successfully completed using the filmmaker's assigned referral code at the time of purchase will be eligible for inclusion in the revenue share calculation. Ticket purchases not associated with the filmmaker's referral code, including purchases where the code was not entered or was entered incorrectly, will not be eligible for revenue sharing.

5. CALCULATION OF REVENUE SHARE

Revenue share payments will be calculated on the net ticket value only.

The following will be excluded from revenue share calculations:

  • Booking fees, processing fees, service fees, and transaction charges;

  • Taxes, duties, and government-imposed charges;

  • Complimentary tickets, staff tickets, sponsor tickets, and promotional admissions;

  • Refunded, cancelled, disputed, or chargeback transactions;

  • Any transaction determined by PLAY THESE LOUD to be fraudulent or invalid.

6. TRACKING AND REPORTING

PLAY THESE LOUD's ticketing platform and internal sales records shall be the sole and final source for determining sales attributed to a filmmaker's referral code.

PLAY THESE LOUD reserves the right to audit, adjust, or remove transactions where errors, duplications, technical issues, or fraudulent activity are identified.

7. PAYMENT

Revenue share payments will be calculated following the completion of the Festival and paid within 30 days of final ticket sales reconciliation. Filmmakers are responsible for providing accurate payment details. PLAY THESE LOUD is not responsible for delays resulting from incomplete or incorrect payment information.

8. PROMOTION

Filmmakers are encouraged to promote their film and referral code through their own channels. Any activity deemed misleading, deceptive, fraudulent, spam-related, or otherwise harmful to the Festival, its attendees, sponsors, partners, or reputation may result in immediate removal from the incentive program and forfeiture of unpaid revenue share amounts.

9. MODIFICATION AND TERMINATION

PLAY THESE LOUD reserves the right to modify, suspend, or terminate the Filmmaker Sales Incentive Program at its discretion where reasonably necessary for operational, legal, commercial, or technical reasons.

10. LIMITATION OF LIABILITY

PLAY THESE LOUD shall not be liable for lost commissions, tracking failures, technical interruptions, platform outages, or other circumstances beyond its reasonable control that may affect referral code attribution.

11. ACCEPTANCE

By participating in the Festival and using an assigned referral code, filmmakers acknowledge that they have read, understood, and agree to be bound by these Terms & Conditions.

FILMMAKER LICENCE & PROMOTIONAL MATERIALS

PLAY THESE LOUD is committed to championing independent filmmakers while respecting their ownership rights. Selected filmmakers retain all rights to their work and grant the Festival a non-exclusive licence to exhibit their film and use submitted promotional materials, including trailers, stills, artwork, and film excerpts, for Festival-related marketing, publicity, media, sponsorship, and archival purposes.

1. RIGHTS & OWNERSHIP

The filmmaker retains all ownership, copyright, and intellectual property rights in and to their film and associated materials.

2. FESTIVAL EXHIBITION LICENCE

By submitting a film to PLAY THESE LOUD and accepting selection, the filmmaker grants PLAY THESE LOUD a non-exclusive, royalty-free licence to exhibit the film as part of the Festival's programmed screenings, including any approved encore, partner, or promotional screenings associated with the Festival.

3. PROMOTIONAL MATERIALS LICENCE

The filmmaker grants PLAY THESE LOUD a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, distribute, and display materials supplied by the filmmaker for promotional, marketing, archival, and publicity purposes relating to the Festival.

 

Such materials may include, but are not limited to:

  • Film stills;

  • Production photography;

  • Posters and key artwork;

  • Press kits and electronic press kits (EPKs);

  • Film synopses and descriptions;

  • Cast and crew biographies;

  • Logos and branding assets;

  • Trailer and teaser content;

  • Social media assets and promotional materials provided by the filmmaker.

4. TRAILER AND EXCERPT USAGE

PLAY THESE LOUD may use trailers, teasers, and excerpts of up to three (3) minutes from the submitted film for promotional, marketing, media, educational, sponsorship, archival, and Festival-related purposes.

5. MARKETING AND PUBLICITY

The filmmaker authorises PLAY THESE LOUD to publish and distribute promotional materials across its channels, including:

  • Website and ticketing platforms;

  • Social media platforms;

  • Digital advertising campaigns;

  • Email marketing;

  • Press and media releases;

  • Printed Festival materials;

  • Festival presentations, sponsor materials, and promotional events.

6. FILMMAKER WARRANTY

The filmmaker warrants that they possess all necessary rights, permissions, licences, and clearances required to grant the rights contained in these Terms and that the use of the supplied materials by PLAY THESE LOUD will not infringe the rights of any third party.

7. NO COMMERCIAL DISTRIBUTION RIGHTS

Except as expressly provided in these Terms, no ownership or commercial distribution rights in the film are transferred to PLAY THESE LOUD. The licence granted is solely for Festival exhibition, promotion, publicity, archival, and related Festival activities.
